Overview

When selling a property in Portugal, the taxable capital gain is not simply the difference between the purchase price and the selling price.

The calculation generally follows this formula:

Capital Gain  =  Sale Value  −  Adjusted Acquisition Value  −  Deductible Expenses



Once the capital gain has been determined, as a general rule only 50% of the gain is considered for Personal Income Tax (IRS) purposes. This amount is added to the taxpayer’s other taxable income and taxed at Portugal’s progressive rates.


1.  How Capital Gains Are Calculated


Adjusted Acquisition Value


The original purchase price is adjusted using the official inflation adjustment coefficients (coefficients of monetary depreciation) published annually by the Portuguese Government. This adjustment reduces the taxable capital gain.

Worked example

Purchase price in 2015:  €200,000

Sale price in 2026:  €350,000

The acquisition value is not treated as €200,000, but as €200,000 multiplied by the applicable inflation adjustment coefficient.


2.  Deductible Expenses


Capital Improvement Works

The following may be deducted:

  • Renovations
  • Property improvements
  • Extensions and structural alterations

 

Provided that:

  • The works were carried out within the previous 12 years;
  • Supporting invoices are available;
  • The invoices are issued in the name of the property owner and clearly identify the property address.

 

Important

The purchase of materials alone is insufficient. The invoice must evidence the work carried out, not simply the goods bought.

Other Deductible Expenses


The following costs may also be deducted:

  • Property Transfer Tax (IMT) paid on acquisition
  • Stamp Duty paid on acquisition
  • Notarial and conveyancing fees
  • Energy Performance Certificate (EPC) costs
  • Estate agency commission

 

Non-Deductible Expenses


According to the current interpretation, the following are not deductible for capital gains tax purposes:

  • Legal fees
  • Solicitors’ and lawyers’ fees
  • General legal consultancy costs


3.  Taxation of Portuguese Tax Residents


Once the capital gain has been calculated, only half of it is brought into the taxpayer’s income.

Worked example

Capital Gain:  €100,000

Only 50% is considered:  50% × €100,000  =  €50,000

This €50,000 is added to the taxpayer’s other income and taxed at progressive rates.


The combined income includes employment income, pension income, and self-employment income. It is then taxed according to Portugal’s progressive income tax bands.

 

Consequence

The sale of a property may significantly increase the taxpayer’s effective tax rate and potentially move them into a higher bracket (between 12.5% and 48%).


4.  Taxation of Non-Residents


Legislative changes introduced in 2023 brought non-residents broadly into line with residents. Under the current rules:

  • Residents and non-residents are broadly subject to the same capital gains regime;
  • Only 50% of the capital gain is taken into account;
  • Worldwide income is considered when determining the applicable tax rate;
  • Tax is effectively levied only on the Portuguese capital gain.

    These changes were introduced to eliminate the discriminatory treatment that previously existed for non-resident taxpayers.

 

5.  Double Taxation Agreements

 

The fundamental principle is that the property is taxed in the country where it is located.

  • Property located in Portugal is taxable in Portugal.
  • Property located in the United Kingdom is taxable in the United Kingdom.

 

Lex Rei Sitae

The law of the place where the property is situated. This is the governing principle for cross-border property taxation.

 

6.  Local Accommodation (Alojamento Local – AL)


A different regime may apply to properties registered for short-term tourist accommodation.


General Rule


Normally, 50% of the capital gain is considered for taxation.


Properties with an Active AL Licence


In certain circumstances, up to 95% of the capital gain may be taken into account, substantially increasing the taxable amount.

How to avoid the 95% rule

The AL licence must be cancelled and the activity must cease;

For a period of 3 years, the property must be used as a permanent residence or let under a residential tenancy agreement for a minimum of 3 years.

Provided these conditions are met, the standard 50% rule may apply once again.


7.  Properties Held by Companies


Where the property is owned by a company:

  • The 50% reduction does not apply;
  • 100% of the capital gain forms part of the company’s taxable profit;
  • The gain is subject to Portuguese Corporate Income Tax (IRC).


8.  Capital Gains Tax Exemption Through Reinvestment


One of the most important reliefs available concerns the sale of a main residence (permanent home / principal private residence). Under certain conditions, the capital gain may be exempt from taxation.

Main condition

The taxpayer must have registered their tax residence at the property for at least 12 months prior to the sale.


Reinvestment Options


1.  Purchase of a New Main Residence in Portugal or Europe


The reinvestment may occur up to 24 months before the sale, or up to 36 months after the sale.


2.  Improvements to an Existing Secondary Property


The property must become the taxpayer’s principal residence within the first 12 months from the sale. The work must be completed within 36 months from the sale of the property.


3.  Building Land and Construction of a New Main Residence


This option involves several conditions:

  • Acquisition of building land;
  • Construction works;
  • Occupancy licence;
  • Registration with the Portuguese Tax Authority.


All stages must generally fall within the period beginning 24 months before the land purchase and project submission to the town hall and ending 36 months after the sale of the permanent home. The habitation licence must be issued no later than 48 months following the sale of the original main residence.


4.  Life Insurance Financial Product

Available to individuals aged 65 or over, or to retired individuals.

 

Investment deadline

The investment must be made within 6 months of the sale, held for a minimum of 10 years, with a 7.5% annual return.


Recent Legislative Developments


Recent State Budget measures and housing initiatives have introduced additional reinvestment opportunities, including:

  • Investment in properties intended for long-term residential letting;
  • Reinvestment through renovation works intended for residential rental purposes;
  • Tax incentives applicable to certain sales of secondary residences.

 

As these measures are subject to legislative amendment and ongoing interpretation, professional advice should always be sought based on the legislation in force at the date of sale.

 


Key Considerations for Owners Intending to Sell


Retain All Supporting Documentation


In particular, keep:

  • Renovation and improvement invoices;
  • IMT receipts;
  • Stamp Duty receipts;
  • Energy Performance Certificate costs;
  • Estate agency commission invoices.

 

These documents may significantly reduce the taxable capital gain.


Consider Reinvestment Carefully


Many taxpayers pay unnecessary tax because they are unaware of the reinvestment deadlines and available exemptions. Planning ahead of a sale is often the difference between a substantial tax bill and full relief.

Exemption on the Sale of a Secondary Residence

Capital Gains Tax Exemption – Sale of a Secondary Residence


According to the explanation provided by the tax lawyer, it may be possible to obtain an exemption from Capital Gains Tax when selling a secondary residence, provided that the proceeds are reinvested in accordance with the specific requirements established by Portuguese legislation.

Broadly, the seller may reinvest the proceeds from the sale into purchasing one or more residential properties intended for long-term rental under the Government’s Affordable Rent Scheme (Arrendamento a Custos Acessíveis / Renda Moderada), as set out in the attached rent schedule.

To qualify for the exemption, the following conditions must be met:

  • The newly acquired property must be rented under the affordable rental programme, respecting the maximum rent limits established by the Portuguese Government;
  • The rental agreement must comply with the minimum duration required by law (currently understood to be at least three years);
  • The property must remain allocated to this purpose and be retained by the owner for a minimum period of five years;
  • All legal and tax requirements in force at the time must be fully complied with.

 

A point to weigh carefully

In practice, this option may not be suitable for all investors, as the rental values permitted under the affordable rental scheme are often significantly lower than prevailing market rents.

 

Provided that all statutory conditions are met and maintained throughout the required period, the capital gains arising from the sale of the original secondary residence may benefit from the applicable tax exemption.

As tax legislation is subject to change and individual circumstances vary, property owners should always seek advice from a qualified accountant or tax adviser before proceeding with any sale or reinvestment strategy.


APPENDIX

Maximum Permitted Rents for 2026


These are the maximum monthly rents permitted under the Affordable Rent Scheme for 2026, set by Decreto-Lei n.º 90-C/2022 of 30 December and ordered by municipality. A property let above these limits does not qualify for the scheme, so reinvestment into it would not secure the capital gains exemption described in this guide.

The columns T0 to T5 refer to the property typology by number of bedrooms: T0 is a studio, T1 a one-bedroom home, and so on up to T5 (a five-bedroom home).
